inp.polri.go.id – Jakarta. Various groups have linked the case of DPR Member Arteria Dahlan's statement with the case of hate speech by social media activist Edy Mulyadi. The termination of the Arteria Dahlan case was accused of the Police being one-sided.
However, Constitutional Law Expert, Dr. Margarito Kamis, S.H., M.Hum., said that from the start the Arteria Dahlan case could not be processed legally.
"It is true that this case could not be processed. We are doomed if legislative members who are simply working (by giving their statement) are punished. Giving statement is part of their work," he explained when contacted in Jakarta, Saturday (5/2/22)
Dr. Margarito Kamis, SH, M.Hum. adds that what Arteria Dahlan said about the application of the Indonesian language was also true.
"There is Law 24 of 2009 concerning the Language, Flag and State Emblem which stipulates that in official meetings, Indonesian must be used, especially by the officials," he explained.
Arteria Dahlan's criticism regarding the use of Sundanese by the West Java Chief of Staff in meetings has drawn controversy. In his criticism, Arteria asked the Attorney General to remove his subordinate. This case was then attracted the attention of many people, and urged Arteria Dahlan to resign from the DPR and be processed legally.
Dr. Margarito Kamis, S.H., M.Hum., reminds that a member of the DPR has law immunity when carrying out his function as a member of the DPR.
"We are doomed, if the people who are protected by the Constitution and are carrying out their legal obligations must be suspended due to political considerations," said the expert on constitutional law.
Therefore, according to the former Special Staff of the Minister of State Secretary of the Republic of Indonesia in 2006-2007, the actions of the police to stop the investigation and/or the investigation of the Arteria case were correct in all aspects.
"I appreciate the police's decision as proceeding this case with their professional attitude. They are doing great, because that is how it should be," said the lecturer at Khairun University, Ternate.
